Toledo-area physician, Dr. Jay Nielsen, is currently in Haiti providing medical and refuge assistance following the earthquake.  Dr. Nielsen has had a long-standing committment to Haiti as director of Missions International of America, a non-profit organization based in Perrysburg, Ohio.  He leads several mission trips each year.  Follow his Haiti blog at http://jayhaiti.blogspot.com/?source=mia

The Ohio Bureau of Workers Compensation has announced that the maximum workers' compensation benefit rate for an injury that occurs in 2010 will be $775.00 per week. The maximum rate for a 2009 injury was $767.00. Thus, this year's increase was just $9.00.  In comparison, the Pennsylvania weekly maximum compensation rate for 2010 is $845.00.  The 2010 Michigan maximum compensation rate is $746.00 per week; which is actually a $7.00 reduction from their 2009 maximum rate of $752.00 per week.

John Polofka has been named 2009-2010 Chairman of the Lawyers and Doctors Committee of the Toledo Bar Association.  The committee oversees the interprofessional relationships between lawyers and doctors in the Toledo, Ohio area.  John has been a member of the committee for several years; and has been a member of the Toledo Bar Association since his admission to practice law in 1980.  He practices primarily in the areas of workers' compensation and social security disability.

The Ohio Bureau of Workers Compensation has implemented a policy requiring strict adherence to a requirement that injured workers submit a fully-completed copy of the C-84 Application for Temporary Total Disability.  Previously, the BWC had processed partially completed forms, with a medical certification, in many cases involving ongoing payment of compensation benefits.  In a related development, the BWC is now accepting electronically signed C-84 forms via the agency's website.

The Northwest Ohio service offices of the Industrial Commission of Ohio are currently staffed by a total of ten hearing officers.  Toledo currently has four District Hearing Officers (DHO); while Lima has one DHO assigned to that office. A District Hearing Officer is assigned to decide initial appeals from decisions of the BWC and self-insured employers. 

There are four Staff Hearing Officers (SHO) currently in Toledo; while Lima has a single SHO.   A Staff Hearing Officer will hear appeals from an District Hearing Officer decision, as well as other issues such as permanent total disability (PTD).  An SHO decision is appealable to the commissioners of the Industrial Commission.  Frequently, hearing officers will travel to different regional offices to conduct hearings as personnel and caseload requires.

Members of the Polofka & Van Berkom office and family participated in the 16th Annual Susan G. Koman Race for the Cure on Sunday, September 27, 2009.  The event was held in downtown toledo, with a reported 18,000 participants.  Each year, the race is held in honor of breast cancer awareness, and in support of those battling the disease.  Our office ran with, and in support, of our own Linda Kruse, a three year survivor of breast cancer.

Effective August 21, 2009, the Industrial Commission of Ohio has merged its Bridgeport and Zanesville offices into a new location in Cambridge, Ohio.  After August 21, 2009, all workers' compensation hearings previously conducted in the Bridgeport and Zanesville locations will be heard in the new Cambridge hearing location.  The Industrial Commission of Ohio claims the merger will result in an annual cost reduction to the agency of $260,000.  No personnel cuts will be made by the merger of the two locations.

Polofka & Van Berkom, LLC recently sponsored and participated in a charity golf event held at Tamaron Country Club in Toledo. 

The event benefited the Mountain Mentors organization, a community outreach program which assists youths and adult mentors in the areas of education, work, family and the courts.

Cody Higley from our office participated in the tournament.  His team of four placed fourth in the event.
